Please read these Terms and Conditions carefully. They govern your use of the Harmoni Chambers website and the basis on which we provide legal services. By using our website or engaging our services, you agree to these terms.

1. Definitions

  • "You", "User" — any person accessing our website or engaging our services.
  • "Services" — the legal services we provide, including separation and divorce, children and guardianship, and mediation and agreements.

  • "Engagement" — a formal agreement to provide legal services, confirmed in writing.
  • "Content" — all text, documents, images, and information available on our website.

2. Acceptance of Terms

By accessing our website or contacting us to enquire about services, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. Use of our website constitutes acceptance of these terms.

An engagement for legal services becomes binding only when we have issued and you have accepted a written Client Care Letter confirming the scope of work, applicable fees, and the terms of the engagement.

3. Services

Harmoni Chambers provides family legal services in Malaysia, including:

  • Separation and divorce guidance and representation
  • Children, custody, access, and guardianship matters
  • Mediation facilitation and settlement agreement drafting

Our services are available to individuals residing in or with matters connected to Malaysia. We do not provide legal advice in relation to jurisdictions outside Malaysia. Website content is provided for general information only and does not constitute legal advice.

4. User Responsibilities

When using our website or engaging our services, you agree to:

  • Provide accurate and complete information in all communications and documents
  • Not use our website for any unlawful purpose or in a way that could harm others
  • Not attempt to gain unauthorised access to any part of our systems
  • Cooperate reasonably with our team during the conduct of your matter
  • Notify us promptly of any changes to information you have provided

We reserve the right to decline or discontinue services to any person who provides false or misleading information or who conducts themselves in an inappropriate or abusive manner towards our staff.

5. Intellectual Property

All content on this website — including text, design, layout, and documents — is the intellectual property of Harmoni Chambers and is protected under Malaysian copyright law. You may not reproduce, distribute, or republish any content from this website without our prior written permission.

Documents prepared by us for your matter remain our intellectual property until all applicable fees have been settled in full.

6. Fees and Payment

Fees for all services are stated in Malaysian Ringgit (RM). Starting fees are indicative; the total fee for any matter will be confirmed in your Client Care Letter before work commences.

  • Fees are payable by bank transfer or cheque unless otherwise agreed
  • Disbursements (court filing fees, third-party expert costs, etc.) are charged at cost and will be agreed with you in advance where reasonably practicable
  • Invoices are payable within 14 days of issue unless otherwise agreed
  • Where a matter is terminated early, fees for work completed to that point remain payable

We do not issue refunds for work that has been carried out. If you have a concern about your bill, please raise it with us promptly and we will address it fairly.

7. Service Terms

Scope of Services

The scope of legal services for each engagement is defined in the Client Care Letter. Any material change to the scope will be discussed with you and confirmed in writing before additional work is undertaken.

Timelines

We will advise you of likely timelines at the outset of each matter. Timelines are indicative and may be affected by court scheduling, the conduct of other parties, or factors beyond our control. We will notify you promptly of any significant change to expected timelines.

Confidentiality

All information you share with us in the context of a legal engagement is protected by legal professional privilege and the obligations set out in our Privacy Policy. This duty of confidentiality continues after the conclusion of your matter.

8. Disclaimers

Website content is provided for general informational purposes only and does not constitute legal advice. It should not be relied upon as a substitute for legal advice specific to your circumstances. Legal outcomes depend on the particular facts of each matter and cannot be anticipated with certainty.

We do not represent that the outcome of any legal matter will be as you might hope. Advice we give is based on the information available to us at the time and on the law as it stands at that point.

9. Limitation of Liability

Our liability to you in connection with our services is limited to the fee paid by you for the specific service to which any claim relates. We are not liable for indirect, consequential, or special losses, including loss of income, loss of opportunity, or reputational damage.

Nothing in these terms limits liability for fraud, personal injury caused by negligence, or any liability that cannot be excluded under applicable Malaysian law.

We maintain professional indemnity insurance as required by the Malaysian Bar Council.

Force Majeure

We are not liable for any delay or failure in performing our obligations that results from circumstances beyond our reasonable control, including natural disasters, government action, or system failures.

10. Termination

Either party may terminate an engagement by giving reasonable written notice. We may terminate an engagement immediately if you provide materially false information, fail to pay fees when due, or act in a way that makes it impractical or unethical for us to continue acting.

On termination, you remain liable for fees for work completed to that date. We will transfer your file to you or your replacement solicitor in a timely manner subject to outstanding fees being settled.

11. Dispute Resolution

These terms are governed by the laws of Malaysia. Any dispute arising in connection with our services will be subject to the exclusive jurisdiction of the courts of Malaysia, with Ipoh, Perak as the agreed venue where possible.

We encourage any concerns to be raised with us directly in the first instance. If a concern cannot be resolved informally, complaints may also be referred to the Malaysian Bar Council.

12. General Provisions

  • Entire agreement: These terms, together with any Client Care Letter, constitute the full agreement between us in relation to legal services.
  • Severability: If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force.
  • No waiver: A failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.
  • Assignment: You may not assign any rights or obligations under these terms without our prior written consent.
  • Notices: Notices may be given by email to the address confirmed in your Client Care Letter, or in writing to our office address.

13. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of our website or services after a change constitutes acceptance of the revised terms. For active engagements, material changes will be communicated to you directly.
